PRIVACY POLICY STATEMENT

 

COMPLIANCE WITH E.U AND SWISS PRIVACY SHIELD PRINCIPLES
      

    UDMS Complies with the E.U.-U.S. and the SWISS-U.S. Privacy Shield Program regarding the collection, retention and destruction of personal medical information in the form of medical files including paper and film media like X-Ray film, microfilm and microfiche transferred from the European Economic Area and Switzerland to the United States. UDMS has certified to the U.S. Department of Commerce that it adheres to the Privacy Shield Principles.            SCOPE

        All personal medical information received by UDMS is collected or received as physical paper files and film and is retained solely for the purpose of destruction per our clients' requests. No personal information is cataloged or maintained on lists or digitally. After Destruction No personal information is retained nor is any transferred to third parties. All personal information will be processed pursuant to Privacy Shield Principles. UDMS is also AAA NAID certified for secure destruction and independently audited by The National Association for Information Destruction. UDMS does not partner with third Parties and does not share information with any parties other than our direct clients who provide the medical files.

 

           ACCESS AND CHOICE

        Our Clients have the right at any time to access their patient records we have received on their behalf. However, as a result of the nature of our service, such records become unavailable at a certain point in the process of destruction. Until such time, our Clients, and their patients, maintain every right under law to request certain records be retuned, and/or not be destroyed until authorization is given to UDMS by Client. UDMS will make every effort to achieve such requests until such time as records are formally destroyed, as described herein.

 

Recourse, Dispute Resolution, Enforcement and Liability

        In compliance with Privacy Shield Principles, UDMS commits to resolve complaints about our collection or use of your personal information. E.U and Swiss individuals with inquiries or complaints regarding our Privacy Shield Policy should first contact UDMS at:

 Furthermore UDMS has committed to refer unresolved EU-U.S. PRIVACY SHIELD AND SWISS-U.S. PRIVACY SHIELD complaints to the American Arbitration Association - International Centre for Dispute Resolution (AAA-ICDR) an alternate dispute resolution provider located in the U.S. If you do not receive timely acknowledgement of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit AAA-ICDR at www.adr.org for more information or to file a complaint. The services of AAA-ICDR are provided at no cost to you.

 

Under certain conditions, more fully described in the Privacy Shield website, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.

 

With respect to Personal Information received or transferred pursuant to the Privacy Shield program, UDMS is subject to the regulatory enforcement powers of the U. S. Federal Trade Commission.

 

Required Disclosure

UDMS may disclose personal data in special cases to conform to legal requirements or to respond to lawful requests by public authorities including meeting national security or law enforcement requirements or to protect and defend our rights or property.
